I bought two cases from him $130.00 he cut everyone open .
he didnt say this in the auction , so i assumed they were civilian.
shouldnt i be pissed ? im really pissed , im trying to get my money back.
they shipped from california and were pipping hot when they got here, the red dot was black almost ....
thought i did well with price etc etc . ya just never know .

If it were me, I'd be pissed and would try to arrange some kind of deal with the seller. On the one had, he *does* say there are no heaters inside. But on the hand, he doesn't say that he *cuts* open every bag to remove them. To me, opening the bags seriously reduces the storage potential for the MREs.
Unfortunately, it's not like returning them is an option because you'd probably have to pay shipping for them - and going back to CA could be pretty expensive.
I'd recommend asking yourself how much you would have paid if you had known he was cutting the FRHs out of the MREs. I'm not sure where you're located (you can set that by clicking "Profile" above and entering your location for all to see), but let's say it cost the guy $20 to ship them to you. That means the MREs were $45 per case. Would you pay $35 for them without the heaters? If so, then ask for $10 back per case.
If he doesn't like that and doesn't give you a decent counter-offer, take it up with eBay and/or PayPal and file a complaint.
As much as I hate the new feedback system on eBay, this is one case where it works to your advantage. You can leave him nasty, negative feedback and he can't do a damn thing about it because he can't leave any feedback for you.

sorry i posted in the wrong area ....
i filed a claim already , then escalated it then left negative feedback .
in the escalation i asked for $45.00 back as a min . ups seems to be a buck a pound .$22.00 a case from florida or california ive paid the same .
im from washington state . 2 block's from fort vancouver if youve ever been there .
i tend to get annoyed quick nowadays and wonder if its me or if everyone else is just incompetant . so i ask would you be pissed cause i dont wAnna be an ass and just mess with people that dont deserve it . but dammit man the bags keep out water , should my camp get flooded etc etc , and wouldnt they age alot faster in general . id try to reseal them i have extra heaters but i dont have a way to get the air out except with a straw...

How did you manage to get two reviews in?
At least he can't retaliate with negative feedback.
A seller tried black-mail on me not long ago. Since the policy change
on E-Bay it became a little more customer friendly.
If you used Pay Pal I am suggesting you call them.
That can be a big help.
If that is the case, speak to customer service in Pay Pal.
Upon speaking to them and while filing a complaint with Pay Pal you indicate to them "item received not as advertised."

my thought is always volunteer nothing , trust no one ..

Andrew, I do understand your discontent with receiving opened MRE's. I also have to ask you why did you not ask about the comment "heaters have been removed"? I stated that heaters were "removed" and "removed" means that they were there at one point in time. I do understand that it it not what you wanted and that being the case you did not even give me the opportunity to resolve your issue with the sealing of the packages. I Have to say that the negative comments you listed were very illigitament and uncalled for as my listing was clear. However, I could have been more informative but you could have asked questions too. The open MRE also does not mean the food is bad as each individual package of food is sealed within each MRE meal and this is the true integrity seal; the outside packaging is strictly for containment purposes. I have refunded you you purchase and I hope you consider this and the comment you have left on my account. My hope is that you will ammend it to neutral.
im looking into making it right but , only on reply for now till i see the white of his eyes , ill tell ya what , if this person gives me back my cash
im gonna have to admit i am an ass and just dissapear , im to drunk right now to think so well see what the morning brings

If it were me, I probably would have waited to see what I could work out with the seller before pulling the trigger on the negative feedback. But that's just my approach and there could be something to be said for getting their attention by dropping the feedback on them right away.
About all I can say about the seller's response is that it sounds like he was assuming the buyer would assume the MREs had been opened. That's two assumptions too many for an eBay transaction. It's easy enough to type "MREs have been opened and the heaters removed" - so why not do that?
And one last thing...I have seen cases of MREs marked "Flameless Ration Heaters not included" on the outside of the case. When I first saw this guy's auction, I wondered if he was selling one of those or if he had opened the case.

your a smart man . i came here after i got my 11.10 ,n 9 yr old mre's there was something wrong and you came up on a google search ... thank you .. i ASSumed they were civilian without heaters .. my bad but .... But ...
if he refunds my cash ..... do i feel bad i think i will , like a thief .
but return shipping would break the whole deal ... lame

After reviewing the auction again I found your complaint valid.
The seller in describing his auction omits many things. What this amounts to is deceptive advertising.
Buyer will receive:1(one) case of MRE's with inspection date of Aug 2009; Case B menus 13-24.
There are no heaters inside the MRE's.
The main thing to consider is the photograph which he says nothing about in his comments. When listed by E-Bay most peoples eyes are drawn to the photo. Why then did he not include a correct photo. In not doing so, he attempted to inflate the price and was successful in doing so. So again, item received was clearly "not as advertised."
His comments to are misleading. He says, "I Have to say that the negative comments you listed were very illigitament and uncalled for as my listing was clear."
Than goes on to say, "However, I could have been more informative..."
Than goes on to blame you. That kind of response puts the onus on the seller because it makes no sense.
The seller was quick to refund your money. It worked out in your favor.
So sober up because you had a every right to leave negative feedback. It goes to show that E-Bay's policy change is working.
One last thing. He says there are no heaters inside the MRE's. He never said the heaters were removed. That is two entirely different things.
That is what you call a word-smith. This is a person who misleads by having you believe one thing as written nevertheless, which means something entirely different.
I can go on and on. And by the way. This has nothing to do with whether the food is good or bad. Nothing to do with it whatsoever.
The only thing that remains is simply return the item using certified mail through the Post Office. Request a signed receipt. That way you'll be covered all the way.
If you send it back you can be confident that your comments will remain valid.

With pictures like the one in that guy's auction, I always wonder if the resolution is good enough for the military to scan the barcode to determine where those MREs originated.
The old barcodes on the MRE cases weren't unique - they just identified the product type. But the new ones like the white sticker contain an RFID tag and a unique serial number.
