And thanks to his posting the full barcode on that RFID tag, he might be getting a visit from the Army's Criminal Investigation Command because they'll be able to tell exactly where those MREs came from. 36 cases of brand-new MREs seems like an awful lot to just appear in someone's garage.

I think he might get a visit from Navy Criminal Investigation Service, since San Marcos, CA is more or less located righ next to Marine Corps Base Camp Pendleton.

And speaking from experience, I've personally gotten a visit from Army CID about 5 years ago after I bought 5 cases of MRE's on eBay. Turns out the guy that was selling them had misappropriated a truck load full during Katrina. I mainly get MRE's now during my drill weekends, and I stay away from eBay. This guy isn't to bright to be selling 36 cases. Someone doesn't just come across 36 cases.

I admit, this thread does leave me curious about military surplus MRE's you can find on Ebay or other sale venues. Mainly in that while the odds are of these cases having been 'lost' are fairly high, what sort of legality may be involved with other smaller quantities one often encounters?

I would hazzard a guess that the "average joe" seller offering meals that are past inspection and date back a ways, whether in cases or individual, probably won't get that much attention. I mean, some guys are selling them to get back money they had to shell out for the meals with no choice in the matter. At least that is what some are claiming and I'll take them at their word.
But someone offering 36 cases of 2014 MRE's, clearly the freshest out there and in quantity(!), is probably going to get someones butt in the air. I can't imagine the cost in man hours tracking down and recovering one case, but 36

I'm sure this is on someones radar. Especially when someones says today its 36 cases of MRE's, tomorrow it's 3 cases of something more dangerous! Also keep in mind how "brown" rolls up hill. If this turns into an investigation and the feces strikes the air ocelator you can be sure heads will roll over a lack of inventory control.
Of course, it could also be as simple as just an "overage" in the order as delivered. But that still doesn't make it okay.

You have to imagine that selling a case or two on ebay is normal and perfectly fine. We see it all the time on ebay and craigslist. So buying one is quite safe even if it is within a inspection date time frame but 36 "fresh" cases AND at the price this idiot is selling them at, makes me wonder if this guy hasn't already had some offline offers. I mean, the price is pretty high for that amount. The seller looks like he hasn't had any bids on it so far. Maybe that's becuase everybody is smart enough to shy away from him.

I agree. As I mentioned the odd seller with a case here or individual meals probably won't get much attention at all. Especially if the meals are older. But suddenly coming out with 36 cases of the freshest MRE's is just a little to....obvious?
I think others are staying away for the same reason(s) you offer. High prices and "hot" product?
Ooh, before I forget I have been meaning to ask. Sorry this is off subject, but is the Breakfast Cake a giant pancake? I've gone on the net and believe it or not can't find a single piece of video or commentary saying what it is or how it tastes. All I could find was that apparently since it has the Maple Syrup packet attached it's USMC procurement as the Army Breakfast Cake doesn't include the Maple Syrup packet, according to the DoD UGR list. Curious....
